Below is the Terms & Conditions (“T&C”) for ASRAR’s online store asrarsecrets.com, drafted in compliance with the Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), the GDPR (Regulation (EU) 2016/679), and other applicable Spanish legislation as of 6 May 2025.

1. Scope and Acceptance

By accessing or using asrarsecrets.com and placing an order, you (“Customer”) unconditionally accept these T&C and our Privacy Policy.
Prior to contract formation, ASRAR provides you with clear, comprehensible pre-contract information as required by LSSI Article 27, including product characteristics, total price, payment, delivery, and right of withdrawal.

2. Definitions

  • Controller / ASRAR: ASRAR – NIF X2144949-S, Calle Padre Vicent nº 12-5, Spain.

  • Customer: Any natural or legal person who purchases products through the Website.

  • Contract: Distance contract concluded under these T&C when ASRAR confirms your order by email.

3. Products, Prices and Payment

3.1. Products

All products, descriptions and prices displayed are subject to availability and confirmation at order time.

3.2. Pricing

Prices are shown in Euros (€), include applicable VAT, and exclude shipping costs (unless otherwise stated).

3.3. Payment Methods

Accepted methods: credit/debit card, PayPal, and other gateways. Payment is debited immediately upon order confirmation. If a payment is rejected, the order will be cancelled.

4. Order Process and Contract Formation

  1. Order Placement: Select products, add to cart, and proceed to checkout.

  2. Order Confirmation: ASRAR sends an order confirmation email containing order details.

5. Delivery and Transfer of Risk

Products are delivered to the address provided by you. Delivery times are estimates; ASRAR is not liable for delays beyond its control. Risk transfers to you upon delivery.

6. Right of Withdrawal and Returns

Under the Consumer Rights Directive, you have 14 calendar days from receipt to withdraw without penalty and without giving reasons. To exercise this right:

  • Notify ASRAR by email (info@asrarsecrets.com) within the withdrawal period.

  • Return products in original condition and packaging. ASRAR will refund all payments including standard delivery costs within 14 days of withdrawal notification, though return shipping is at your expense.

  • For hygiene reasons, lingerie or unpacked products will not be suitable for refund requests.

7. Guarantees and Complaints

Non-defective products: no guarantee.
Defective products: two-year legal guarantee against manufacturing defects. To claim, contact ASRAR within two months of defect discovery.

8. Intellectual Property

All content (text, images, trademarks, logos) on the Website is ASRAR’s property or used with permission. No license is granted for its use without prior written consent.

9. Liability

To the fullest extent permitted by law, ASRAR’s liability is limited to direct damages proven and capped at the total amount paid for the order. ASRAR is not liable for indirect, special or consequential damages.

10. Force Majeure

ASRAR is not liable for failure to perform obligations due to events beyond its reasonable control (e.g., strikes, natural disasters, regulatory changes).

11. Modifications to the T&C

ASRAR may update these T&C at any time. Changes take effect upon publication on the Website. The “Last Updated” date below reflects the current version.

12. Applicable Law and Jurisdiction

Contracts are governed by Spanish law. For consumers, mandatory jurisdiction lies with courts of your residence. Otherwise, Barcelona courts have exclusive jurisdiction.
